Who is the employer. A family that hires you directly is your employer. BLS defines the Kingston, NY metro as Ulster County alone. In May 2025 it counted 2,110 home health and personal care aides, a location quotient of 1.29 (more common than nationally). Their median was $18.15 an hour and their mean $19.46; the lowest-paid tenth earned under $17.28 and the top tenth over $22.53. Statewide the median is $19.05 across 663,140 aides. The 540 nursing assistants in the metro had a $21.50 median. In the remainder-of-state region that includes Ulster County, New York's general minimum is $16.00 for 2026 and, the Department of Labor says, will not rise on January 1, 2027. The region's home care aide minimum is $18.65 for 2026, going to $19.00 at the start of 2027. The survey predates the 2026 step, so compare an agency offer with $18.65, not with the median.

Rules

Caregiver requirements in New York, applied to Kingston

New York's home care aide minimum wage applies to home health aides, personal care aides, home attendants, CDPAP personal assistants and any other licensed or unlicensed person whose main job is helping someone at home with daily activities or health-related tasks, says the Department of Labor's P105 fact sheet; casual workers are excluded, and so are relatives working under a government-funded program, except relatives hired through CDPAP. It also lists call-in pay and an extra hour's pay for workdays longer than ten hours. When a family employs you directly, the state's domestic worker law gives overtime after 40 hours (44 if you live in), a 24-hour rest day every seven days and, after a year with the same employer, three paid days of rest. Under federal law, the U.S. Department of Labor says, a household worker who lives in is still owed the minimum wage even though the overtime rule does not reach them.
